VA Benefits: Why do I need an attorney?

Thank you for your service. The United States Department of Veterans Affairs (“VA”) offers many benefits to our veterans, including money directly deposited to their bank account each month. Unfortunately, the VA claims system has a reputation of difficulty due to errors and delays in processing. Veterans may seek free assistance through a local veteran service officer, however many situations require a qualified, legal professional due to complex, financial circumstances.

There are two (2) main types of VA Claims our firm processes for Veterans:

  1. Non-Service Connected Disability Pension Benefit with Aid and Attendance
    Aid and Attendance is a benefit available to veterans, their spouses, widows or widowers. This benefit is the highest level of pension available and is designed to offset to help offset the cost of nursing homes, assisted living communities, and personal care homes. To qualify for this benefit Veterans must have met the following criteria:

     

    – Served at least 90 days on active duty, one day of which was during a period of war
    – Discharge was other than dishonorable
    – Veteran is over 65 years of age or disabled
    – Veteran and/or spouse have limited income and net worth
    – Assistance of another person is needed to help you perform at least two (2) activities of daily living (ADLs), like bathing, feeding, and dressing

     

    Benefits are paid directly to the claimant and are retroactive to the date of application. Payments are tax free, and below are the maximum allowed amounts as of 12/1/2023:
     

    – Single Veteran $2,300 monthly / $27,609 annually
    – Married Veteran $2,727 monthly / $32,729 annually
    – Surviving Spouse $1,478 monthly / $17,743 annually
    – Veteran Married to Veteran $3,649 monthly / $43,791 annually

     

  2. Service Connected Disability Claims
